:This course examines certain non-Charter aspects of the Canadian Constitution. The first part of the course focuses on federalism and the division of powers between the federal and provincial governments in Canada, and current patterns of inter-governmental relations. It will also consider the constitutional status of Canada’s three territories. Particular attention will be directed to division of powers analysis and heads of power entrenched in sections 91, 92 and other provisions of the Constitution Act, 1867, including peace order and good government, trade and commerce, property and civil rights, and the criminal law power.The second part of the course focuses on Indigenous Peoples and constitutional law of Canada, with particular attention to section 35 of the Constitution Act, 1982.
